of acceptance

• The booking holder declares that they are making the booking on their own behalf and, where applicable, on behalf of the other people included in the same booking.
• They also declare that they will inform everyone included in their booking of the basic conditions for taking part in the activity and of the contents of this declaration.

The booking holder acknowledges that, before the activity begins, the technical staff of MENORCA EN KAYAK will provide participants with the necessary, understandable information about:

1. Destinations, itineraries or routes to be followed.
2. Measures to protect the environment in which the activity takes place.
3. Required knowledge, difficulties inherent in the activity and what to do in the event of danger.
4. Physical requirements or skills needed for the activity and medical conditions that make participation inadvisable.
5. Planned safety measures.
6. Equipment to be used.

• The booking holder declares, on their own behalf and, where applicable, on behalf of the other people included in the booking, that participants are in a suitable physical and mental condition to undertake the booked activity.
• They also undertake to report, before the activity begins, any injury, illness, physical limitation, pregnancy, allergy, emergency medication or other relevant circumstance that may affect the safety of a participant or the group.
• Participants must not undertake the activity while under the influence of alcohol, drugs or other substances that may impair their physical ability, reactions or judgement.

• The booking holder acknowledges and accepts that active tourism activities, particularly kayaking, kayaking and hiking, snorkelling or Big SUP in the natural environment, involve inherent risks that cannot be completely eliminated, even when appropriate safety measures are taken.
• Participation in the activity involves informed acceptance of these risks, without prejudice to the statutory rights of consumers and users.

• The booking holder declares that participants undertake to follow the instructions of the MENORCA EN KAYAK guide, instructor or technical staff at all times, to use the equipment provided correctly and to comply with safety and environmental protection rules throughout the activity. Article 122 of Decree 20/2015 expressly requires this undertaking to be signed by the participant.

• If the booking includes under-18s, the booking holder declares that they are acting as the child’s parent or legal guardian, or that they have the appropriate authorisation to make the booking and allow the child to take part in the activity.

• MENORCA EN KAYAK may prevent or interrupt anyone’s participation if their personal circumstances, conduct, physical condition or failure to follow staff instructions could make the activity dangerous for them, the rest of the group or the environment.

• Personal data provided through this form will be processed by MENORCA OUTDOOR, S.L. (trading name: Menorca en Kayak) to manage the booking, deliver the booked activity, manage the customer relationship and comply with applicable legal obligations.

The legal bases for processing are performance of the contractual relationship, compliance with legal obligations and, where applicable, the consent of the individual concerned or their legal representative.

Data will not be disclosed to third parties unless required by law or necessary to deliver the service correctly, including providers involved in managing the booking or insurers associated with the activity.

You may exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability by sending a request to info@menorcaenkayak.com or by post to C/ Tramuntana, 9, Es Grau – Maó, 07700, Illes Balears.

Further information about data protection is available in the Privacy Policy published on the website. The correct title of the applicable Spanish law is Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights.
